Imran Khan ordered to leave India by October 28 over Mumbai political protest
Immigration authorities issued an exit notice to the OCI cardholder after he took part in an agitation against the Chief Election Commissioner.

Actor Imran Khan has been directed to leave India by October 28 following his participation in an unauthorized political agitation in Mumbai.
The Foreigners Regional Registration Office (FRRO) issued the exit directive after Bharatiya Janata Party leader Kirit Somaiya submitted a formal complaint questioning how a foreign national could take part in domestic political protests. Khan, an American citizen who resides in the country under an Overseas Citizen of India (OCI) card, was among several demonstrators detained by Mumbai Police on October 10 at August Kranti Maidan.
Demonstrators at the venue had gathered to demand the resignation of Chief Election Commissioner Gyanesh Kumar, alleging procedural issues around the Special Intensive Revision of electoral rolls. Mahatma Gandhi’s great-grandson Tushar Gandhi was also detained during the police action.
Following the event, Somaiya approached Mumbai Police to seek scrutiny of Khan’s legal standing, noting that foreign nationals are strictly barred from participating in political agitations on Indian soil. The complaint was subsequently transferred to the FRRO, which enforced statutory immigration protocols.
Rights of Indian citizens compared with OCI cardholders
While the OCI framework provides extensive economic and residential benefits to foreign nationals of Indian lineage, it strictly excludes the sovereign political privileges reserved for Indian citizens.
| Privilege | Indian citizen | OCI cardholder |
|---|---|---|
| Constitutional assembly rights | Guaranteed under Article 19 | Not applicable |
| Right to vote | Full voting rights | Not permitted |
| Electoral contestation | Eligible for office | Not permitted |
| Visa requirement | None | Lifelong multiple-entry visa |
| Agricultural land ownership | Permitted | Prohibited |
Legal boundaries governing foreign nationals
The enforcement action underscores the clear legal distinction between immigration privileges and constitutional rights. Under the Constitution of India, fundamental freedoms of speech, expression and peaceful assembly under Article 19 are explicitly reserved for citizens of India.
Foreign nationals residing under the OCI scheme are exempt from routine police registration, but they remain subject to Indian immigration laws. The Central Government retains the statutory authority under the Citizenship Act, 1955, and related immigration statutes to order the departure of any foreign citizen or cancel an OCI registration in the interests of public order, national sovereignty and state security.
Neither Khan nor his representatives have publicly indicated whether they intend to challenge the FRRO directive before the October 28 deadline.
